Quick Facts On Social Security Disability

Your medical condition must prevent you from doing ANY work 8 hours a day, 5 days a week, 52 weeks a year. The rules are relaxed if you're over 50. Further reductions in the standards of judgment are made at ages 55 and 60. If, at any age, you're able to work between 21 and 40 hours per week, then you need not apply. If you're not able to work at all in the competitive marketplace, or only up to 20 hours per week, then you should apply.

70% of those who apply are denied. Hundreds of thousands give up at this point.

THE BIG SECRET: The medical examiners at your state agency (Disability Determination Services) does not  care about what you have to say about your condition. They only look at what your treating physicians say. THE BIG LIE: In the name of protecting individual rights, the state agency pretends that what you have to say about your condition matters. It doesn't.

85% of those who appeal their initial denial are denied.

It takes 5 months to get an answer after the initial application.

It takes between 4 and 5 months to get an answer on an appeal of the initial denial. (Reconsideration).

The average length of time it took to get a hearing after a request for a hearing was 485 days (16 months) from the date one asked for a hearing. In 2005, virtually none of the 141 hearing offices met the Administration's goal of 250 days from the time one asks for a hearing to the time one gets a hearing.   Two offices - Colorado Springs and McAlester, OK --were able to come closest to the 250 day goal, with 9 months.

Claims which are based on one’s work record (Title 2) only are paid within 30 to 45 days.

Claimants for whom both an insured (Title 2) and  SSI (Title 16) application are opened take 3 to 6 months to be paid.

If you choose to go it alone (without a representative) to a hearing, you have a 41% chance of winning; with a representative, your chances of winning increase to 63% -- a 22% increase. (Source:SSA/OHA Case Control System)
